Idea Music on Mobile Contest Gujarat 2015:
This Contest is purely on a “best effort” basis and participation of eligible Subscribers in this Contest is voluntary. To participate and win gratification in this Contest, a Subscriber/Participant shall have to fulfill the following criteria-

Participant has to dial short code 543213 and 56565/57777 pay per use for participating in the Contest. During the Contest Period, a Subscriber may dial short code 543213 and 56565/57777 any number of times each day to participate in the Contest (hereinafter referred to as “efforts/attempts”).

Further, the Subscriber participating in this Contest and generating the highest Minutes of Usages (MOUs) during the Contest Period by using the Service for maximum time period and chosen as Highest Scorer under the Contest in accordance with the Terms and Conditions of this Contest, shall be eligible to the gratification only if he is the registered Subscriber of the mobile phone number (“Eligible Subscriber”).

Duration/ Period of the Challenge:
This Challenge is open for a limited period from 8th September 2015 00:00:00 hours till 7th October 2015 23:59:59 hours (“Challenge Period”).

Gratification scheme:
In all, total six (6) i.e one (1) Mega Top Performer and five (5) Top Performer shall be declared by Idea Cellular Ltd. And Spice Digital Ltd, as per selection criteria mentioned in sub clause 3.2 above.

The allocation of Gratifications to the Top Performers/ Top Scorers is as under:
** One Mega Top Performer shall be eligible for the gratification of a mobile phone worth up to Rs. 10,000/- only.
** 5 Top Performers shall be eligible for the gratification of gift voucher worth Rs. 1000/, each.
** It is understood and agreed by the participants that mere participation to this Challenge during the Challenge Period i.e. from (8th September 2015 00:00:00 till 7th October 2015 23:59:59), does not entitle the participant/ subscriber/s to claim the Gratification. He /she should be declared Mega Top Performer and Top Performer by Idea Cellular Ltd and Spice Digital Limited in conformity with the terms of clause 3.2, to claim the Gratification(s) mentioned in clause 4 of this T&C. The gratification offered in this Challenge is subject to availability.

Procedure and Eligibility to participate:
** “Idea Music on Mobile CONTEST 2015” is valid for all active Prepaid and Postpaid Idea Subscribers of Idea Gujarat circle only.
** Subscriber must be necessarily 18 years or above.
** Subscriber must be a citizen of India.
** Subscriber must not have been either prosecuted or convicted for any criminal offence/s nor be of an unsound mind and has a firm contractual capacity.
** Subscriber must not be under any legal disability e.g. insolvency, restraint by Court Order and/or is prohibited from entering any contractual relationship
** Subscriber must necessarily belong to Gujarat Circle only and no in roamers will be able to participate.
** Subscriber must be an active Subscriber or customer of Idea Gujarat Circle during the announcement or selection of winner.
** “Idea Music on Mobile CONTEST 2015” will be available on OBD, USSD, SIVR & SMS
** Further, the winner will be the original Subscriber of the eligible mobile phone number allocated in his/her name only (MSISDN). If the winner is not able to provide sufficient proof and evidence to show that he/she is the original subscriber of the mobile number, Idea reserves all the right/s to consider the next eligible Subscriber for the Gratification or to forfeit the Gratification, at its sole discretion.

Wining subscriber selection criteria:
At the end of the Contest Period, a knowledge based question will be asked to top ten (10) Subscriber short listed on the basis of maximum minutes of usage (MOU) of the Service. The top six Subscriber who shall generate maximum score while giving the correct answer to the knowledge based question (“Top Performer(s)”) shall be eligible to win the gratification, as per mentioned above under “Gratification”. Below points explain in details the selection of Winning Criteria

There will be one Mega Top Performer and 5 Top Performers eligible for winning the Gratification.

Idea Marketing Team and Spice Digital has the technology to check the Minutes of Usage (MoU’s) by every participant. At the end of the contest period, top 25 customers with highest MoU’s will be selected as mentioned in sub clause 3 (iii) above, who shall generate maximum score while answering the knowledge based question will be declared as Mega Top Performer at the end of the Challenge Period (irrespective of his/her attempts/efforts to the Challenge).

Apart from the shortlisted Top Performer who shall generate the maximum score and declared as Mega Top Performer, five (5) other shortlisted Top Performer shall be declared as the “Top Performer” (irrespective of his/her attempts/efforts to the Challenge).

In case of a tie of score, for the selection of Mega Top Performer and Top Performer, a further tie breaker round of knowledge based question shall be asked to those Subscriber having same score. Such subscriber who shall generate maximum score while answering the knowledge based question in such tie breaker round in minimum time shall be declared as Mega Top Performer and Top Performer, as the case may be.

Criteria for contacting the Winners:
After the selection and validation of the winner, winning Subscribers will be contacted by Idea Cellular Gujarat, through Phone and SMS for gratification. Once contacted successfully, the subscriber has to collect the gratification from the Idea Cellular Office in Ahmedabad within 10 working days of having contacted. If the subscriber is unavailable, or does not contact Idea Cellular office in Ahmedabad within 10 days, the gratification will be extended to the next eligible subscriber. In the event that any of the successful Participants are ineligible or are disqualified, for any reason whatsoever, the organizers reserve the right to forfeit the gratification, at their absolute sole discretion.

All gratifications must be claimed by the successful subscriber on production of all legible, legitimate and necessary documents as listed below at Idea Cellular Office in Ahmedabad.

The document list is only inclusive and not exhaustive and can be changed as per the requirements of Law:
** Identity Proof
** Address Proof
** Proof of holding the Idea telephone connection
** Letter of AUTHORITY signed in presence of 02 witnesses for and on behalf to collect the gratification in case the winning subscriber is not able to physically come to collect the gratification
** PAN Card (In case the gratification value is in excess of INR 10,000)

Any gratification of value in excess of INR 10,000/- in a year will attract deduction of tax at source and all taxes to be paid on the gratification/s shall be paid by the Winning subscriber at the prevailing rate. Further, all Winning subscriber who has won a gratification of value in excess of INR 10,000/- must furnish a valid Indian PAN Card to claim the gratification, irrespective of the value of the same, failing which the Winning subscriber’s gratification shall be forfeited, or the prize shall be rolled over to the next eligible subscriber, at the sole discretion of the Organizer(s).

An Idea Subscriber, by participating in the Contest, hereby agrees to the Terms and Conditions and gives his/her consent to the process of selecting the Successful Offer winner as set out herein, and any appropriate changes that may be made to this Offer by the organizers due to Statutory or Mandatory, instructions from any Governmental, judicial or a quasi-judicial body or due to any natural calamity beyond the reasonable control of Idea Gujarat/ Hungama (Spice Digital Ltd), its affiliates and associates.

Idea Cellular Ltd shall not hold and will have no liability in case someone is not able to participate on account of his inability to pay a minimum subscription charge of Re 1 towards the service

By entering the Offer, subscriber confirms and waives the applicability of rules and regulations of the “National Do Not Call Registry” and also agrees to receive promotional messages from Idea cellular/ the organizers, as they may in their sole and absolute discretion decide and deem fit.

The subscriber hereby understands and gives his/ her irrevocable consent for personal information relating to the participant to be exchanged with Idea, Spice Digital Ltd.and its vendors or published and/or communicated to/in any media that it may deem fit, and Idea, Spice Digital Ltd. or its Vendors may, at their sole discretion choose to publish or disclose the name(s), phone number(s), score(s) and/or photographs of all Subscribers who has participated in the contest, if required, and specifically, of successful Subscriber.

Subscriber who has participated in the contest acknowledge and agree that all copyright and trademarks and all other intellectual property rights in the content/website/portal and all material or content related to the Offer shall remain, at all times, owned by the Organizers / their respective owners. All material and content contained in this website is made available for participant’s personal and non-commercial use only. Any other use of the material/ content on this website and/ or any information disseminated by SMS or any other means of communication are strictly prohibited.

Idea/ Spice Digital Ltd. is neither responsible nor guarantees the quality of the goods/services being offered as gratifications nor is/would it be liable for any defect or deficiency of goods or services so obtained/availed, by the participants under this Offer. Idea / Spice Digital Ltd. Is also not liable for any defect/ deficiency in the gratification(s) so offered or availed, by the participants under this Offer.

The gratification(s) under the Offer is neither assignable nor transferable under any circumstances at any time & or in any manner. All the gratification/s is / shall be subject to such other terms and conditions as may be applicable to specific gratifications and shall have to be duly complied with by the successful Subscriber

All incidental costs/taxes/levies related to the gratification(s), if any, shall be exclusively borne by the participant, including but not limited to TDS, Gift tax (if any), Road Tax, Insurance and any other taxes applicable by the Central, State or Municipal government.

The employees of Idea Gujarat/ Spice Digital Ltd. and their group companies, affiliate or associate companies shall not be eligible to win any of the gratifications offered in this Offer.
