YINDIA Online Garba Contest 2015:
1. The YINDIA Online Garba Contest is valid only for Indian citizens who have attained the age of 18 years or above, residing in India except employees and family members of Saam TV, Sakal Media Group and its affiliate / associate / subsidiary companies and their suppliers, advertising agencies and event Management Company.
2.The Contest shall be valid till 22nd October, 2015 only. No entries post 10.00 pm on 22nd October will be accepted.. Participants stand a chance to win prizes worth upto Rs.1 lakh from Saam Tv.
3. To participate & be eligible to win the contest, the participants must do the following:
i) Like the Saam Tv Facebook page
ii) Follow @SaamTvMarathi on Twitter
iii) Shoot your best Garba step through mobile phone,handycam or camera
iv) Your entries should be in good audio and video quality
v) Send in your entries in Mp4 Video format with “SUBJECT : YINDIAGarba Contest Entry” on contest.saamtv@gmail.com or Whatsapp on 8888849034
vi) Mention your Full name, Email ID, Contact No.and Place of your recording
vii) Entries without YINDIAGarbaContest will not be accepted
4. 2 couple winners and 2 individual winners based on popularity and critics each will be selected by Saam TV and announced on 30th October 2015. Winners of the contest will be contacted individually as per the contact details provided by the participants.
5. Entries should not (i) contain any inappropriate, harmful, vulgar, obscene, derogatory, pornographic, abusive, harassing, threatening, hateful, objectionable or offensive language or content; or (ii) should not violate the rights of any party; or (iii) contain anything which, if published, would adversely affect the reputation of Saam TV.
6. In the event that a winner is unreachable, ineligible, or fails to claim the Prize in the time required, the winner shall forfeit their Prize.
7. This Contest is in no way sponsored, endorsed or administered by, or associated with, Facebook or Twitter. Participant(s) are providing their videos/information to Saam TV and not to Facebook or Twitter, voluntarily.
8.By participating in the Contest, the participant hereby consents to the accessing of information and/or images of the user on Facebook by Saam TV and/or its event management company for the purpose of this Contest. Further, Saam TV shall be at liberty to use the entries received for its media coverage, advertisement or publicity in any form which is existing today or will be known anytime in the future without any further consideration to the participants including promotion of any products manufactured, distributed and/or supplied by it. We also reserve the right to pull out an entry if deemed inappropriate.
9. The participation in the Contest is voluntary. Participation in this Contest constitute acceptance of these terms and conditions. By participating in this Contest, participant agrees to receive communication(s) from Saam TV and/or its event management company relating to the Contest and participant unconditionally agrees not to make any claim or raise any complaint against Saam TV and/or the event management company in this respect.
10. All winners are subject to verification, including without limitation, verification of eligibility through checks as deemed appropriate by Saam TV and complete compliance with these terms and conditions; Saam TV reserves the right to verify the winner’s details either on its own or through its authorised agency / person and the winner shall provide all necessary assistance in such verification. In exercising this right, Saam TV may ask the winner to provide any documentary or another form of evidence, and if evidence does not establish the same then Saam TV, in its sole discretion, will have the right to disqualify the winner.
11. Saam TV shall not be responsible for system outages, delays, equipment malfunctions, errors or data loss of any kind, lost or unavailable connections, or failed, incomplete, garbled or deleted transmissions or other technological difficulties or any other force majeure event that may prevent a participant from participating in the Contest.
Further, Saam TV will not be responsible or liable for:
(a) any failure to receive submissions due to transmission failures and other conditions beyond its reasonable control;
(b) any late, lost, misrouted, or damaged transmissions or entries or prizes;
(c) any computer or communications-related malfunctions or failures;
(d) any disruptions, losses or damages caused by events beyond the control of the Promoter; or
(e) any printing or typographical errors in any materials associated with the Contest or
(f) any delay, damage, non-receipt, lost, misrouted prizes.
12. Saam TV will not be liable for delay in the delivery of prizes due to non-availability of stocks or for any other reason beyond its control.
13. In the event of any conflict or inconsistency regarding any instructions, rules and conditions on any advertising or promotional material relating to the Contest, these Terms and Conditions shall prevail over all such other instructions, rules and conditions.
14. The prize cannot be exchanged with any product or item, is non-transferable and cannot be en-cashed under any circumstances. Accessories, if any shown with the prize shall not form part of the prize to be provided to the winner. Saam TV shall not be liable for any loss or damage due to Act of God, Governmental actions, other force majeure circumstances and shall not be liable to pay any amount as compensation or otherwise for any such loss.
15. By participating in the Contest, each participant represents and warrants that he/she is legally competent to enter into binding contracts under applicable laws. By taking part and/or entering into the Contest the participant warrants that all information provided by the participant regarding its name, age, state, city, address, phone number, etc., is true, correct, accurate and complete and that the participant is authorized to provide such information and consents to the use of such information by Saam TV and/or its event management company.
16. Saam TV reserves the absolute right to amend the terms and conditions of the Contest or extend the Contest Period or cancel or discontinue the Contest or any part thereof without giving any reasons or prior notice. Saam TV reserves the right to substitute the prizes under this Contest with prizes of equivalent value, at its sole discretion. The contest shall be void if prohibited by law. In such case, Saam TV shall not be liable to provide any gift(s)/ prize(s) or compensation to the winner on any account.
17. The contest shall be void in any state where prohibited by law. In such case, Saam TV shall not be liable to provide any free cash-back, gift(s) or compensation to the participant on any account.
18. Failure by Saam TV to enforce any of its right at any stage does not constitute a waiver of those rights.
19. By entering the Contest, the participant agrees that Saam TV shall not be liable for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or with the acceptance, possession, or use of any prize (except any liability which may not be excluded under applicable law).
20. The decision of Saam TV in relation to the Contest and matter incidental thereto shall be final and binding on the customer. Dispute if any respect of the Contest should be sent in writing to Saam TV. The existence of the dispute, if any, shall not constitute a claim against Saam TV. Any and all disputes, controversies and conflicts (“Disputes”) arising out of the Contest shall be referred to a sole Arbitrator to be appointed by the director of Saam TV in accordance with the Arbitration and the Conciliation Act, 1996. The place of arbitration shall be Mumbai and the language used in arbitral proceeding shall be English. Subject to the dispute resolution procedure as set out here in above, the courts at Mumbai shall have the exclusive jurisdiction in respect of all the subject matter with relation to the Contest.
21. This Offer is subject to laws of India including tax regulations as may be applicable to the winner as per eligibility criteria.
22. Any tax liability in respect thereof shall be to the account of the winner.
23. Saam TV reserves the right to withdraw, change, alter & modify the service & whatsoever offered hereunder any time with or without notice; on Regulatory reasons and/or any other reasons without any liability to the consumer. The winner shall be liable to pay applicable TDS, Service Tax, Sales Tax & all other applicable taxes & any other amendments in respect thereof.
24. Final prizes will be distributed to the winners subject to fulfillment of Terms & Conditions of the offer and submission of TDS amount with local Govt. office/Bank and representation of challan copy (if applicable).
