English Oven Khao London Jao Contest 2015 :

Mrs. Bector’s Food Specialities Ltd. (herein after referred to as “MBFSL”) “English Oven Khao London Jao” contest (herein after referred to as “Contest”) is valid in India, from <<<00:00 Hrs>>> on 18th June 2015 till 17th August 2015<<<23:59 Hr>>>, or such further extended period as may be decided by MBFSL for all residents of India who are above 18 years of age.

This Contest is being conducted by HT Mobile Solutions Limited, on behalf of MBFSL, hereafter referred to as the Event Management Company. It is made clear that the Event Management Company shall only ensure the technical part related to contest only i.e. receipt of SMS’s, collection and reporting of collected SMS’s to MBFSL. For any other issues, except the technical part of the contest as mentioned hereinabove, related to the contest i.e. prize claim etc., Event Management Company takes no liability of any nature whatsoever. In order to participate, participants must have a valid cellular GSM or CDMA phone connection that is accessible at all times.

Upon purchase of minimum 1 Pack of selected products of English Oven (Premium Sandwich , Jumbo Sandwich, Brown Bread, Atta Bread 400g, Milk Bread 400g, Sandwich Bread 400g, Burger bun 4Pcs, Burger Bun 6Pcs, Kulcha Bread, Pav, Hot Dog, Pizza Base, Brown Plus, Sandwich Plus, Club Sandwich, Big Seed Buns, Fruit Bun 2pcs, Fruit Bun4pc ) from dealers across Delhi (NCR) only, the customer needs to send a SMS of the unique Alpha-numeric serial number (printed on Pack) to 54242, allowing the customer to participate in the Contest.

Winners of the Contest will be selected by MBFSL, during the Contest Period. These entries will be identified by the means of software managed by the Event Management Company and validated by MBFSL.

MBFSL will select all the winners through a system generated draw based on the coupon code.

The participation is voluntary. Participation in this activity will be construed as an acceptance of the Terms and Conditions stipulated herein.

MBFSL shall not be responsible for any untoward incident/accident/mishap and consequent damage to the person/prize winner while during his/her trip.

Each serial number has a fair and equal chance of winning the Prizes. The results announced will be final and binding.

The winner(s) will be intimated through a message on his/her mobile and a follow-up call from the Event Management Company.

Procedure to be followed by the Customer:

** A customer needs to purchase any English Oven (Premium Sandwich, Jumbo Sandwich, Brown Bread, Atta Bread, Milk Bread, Sandwich Bread, Burger Bun 4pcs, Burger bun 6 Pcs, Kulcha Bread, Pav, Hot Dog, Pizza Base) from any retail shop/ Modern Trade Outlet. Each of the selected products of the MBFSL will have a special Band on the product with the Contest Details on the Pack will have a unique serial number printed in the form of a unique alphanumeric code.

** The customer will have to SMS the unique alphanumeric serial number printed on the wrapper to 54242, in the format EO.

** For e.g. if the customer purchases a English Oven product bearing the alpha- numeric code “ab121234” then the customer needs to SMS “EO ab121234” to 54242.

** If the code sent is correct and in the correct format, the customer will receive an acknowledgement message saying “THANKS FOR PARTICIPATING ENGLISH OVEN KHAO LONDON JAO CONTEST. YOU WILL HEAR FROM US AGAIN IF YOU ARE SHORTLISTED AS A WINNER. KINDLY KEEP THE WRAPER WITH ALPHANUMERIC CODE WITH YOU FOR VERIFICATION. T & Cs APPLY”

** Each SMS sent by the customer will be charged at premium charges of Rs. 3/- per SMS.

** MBFSL will not be responsible for any loss of opportunity to participate in the contest nor be held liable for any loss as a result of customer not being able to send the correct or incorrect format to 54242 or if customer loses the Wrapper from where the alphanumeric code to participate in the contest was obtained.

** MBFSL accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, unique codes, documents, claims or correspondence whether due to error, omission, alteration, tampering, unauthorized data hacking, deletion, theft, destruction, virus attack, transmission interruption, communications failure, hardware failure or otherwise. MBFSL shall not be liable for any consequences of user error including (without limitation) costs incurred.

** By participating in this Contest, the participant agrees to receive communication(s) from MBSFL and/or the Event Management Company relating to the Contest and the participant unconditionally agrees not to make any claim or raise any complaint against MBFSL and/or the Event Management Company in this respect.

** No entries by surface mail, courier, email, or any other means of communication other than those specified above shall be entertained. In case of any queries relating to the Prizes or Contest, the winners can dial 0124-4822677 or send an email to info@eocontest.com

** The winner has to claim the Prize within 10 days from receiving the notification from MBFSL by presenting the original Wrapper on which the alphanumeric code is printed and has been used to participate in the Contest. MBFSL will withdraw the Prize to the concerned participant if the concerned Wrapper is not produced at the time of claiming the Prize.

** MBFSL reserves the right to verify the authenticity of the winner’s identity, resident status in India and age. In exercising this right, MBFSL may ask the winner to provide any documentary or other form of evidence, and if evidence does not establish the same then MBFSL, in its sole discretion, will have the right to disqualify the winner.

** The location at which proof of winning has to be provided will be informed to the winner at the time of informing him/her of their winning the Prize.

** Any request for exchange of Prize for cash or any other form of gratification or reward will not be entertained. The Prizes are non-transferable.

** MBFSL will not be liable for any delay in delivery of Prizes due to non-availability of stocks or for any other reason beyond its control.

** All prizes are subject to Indian Tax Laws. Any Tax liability arising from the receipt of the Prize won shall be borne by the Winner. The Winner shall have to remit the tax applicable before collecting the Prize. The Prizes will be handed over to the winners only upon production of Permanent Account Number by the winners.

** MBFSL reserves the right to extend, cancel, discontinue, withdraw, change, alter or modify the terms of the Contest at its sole discretion without any notice or liability at any time during the validity with or without notification and without assigning any reason. The decision of MBFSL shall be final and binding regarding this Contest, and parameters to decide the winner. No correspondence shall be entertained in this regard.

** In the event of any conflict or inconsistency regarding any instructions, rules and conditions on any advertising or promotional material relating to the scheme, these Terms and Conditions shall prevail over all such other instructions, rules and conditions.

** By participating in the Contest, each participant represents and warrants that he/she is legally competent to enter into binding contract under applicable laws. By taking part and/or entering into the Contest the participant warrants that all information provided by the participant regarding its name, age, state, city, address, phone number, etc., is true, correct, accurate and complete.

** The Contest is open to all Indian residents (except employees and family members/ of MBFSL and its affiliate/ associate/ subsidiary companies and their suppliers, advertising agencies and HT Mobile solutions.)

** MBFSL and its management firm reserve the right to use the winner’s testimonial in any future marketing or promotional material and the same shall be the sole property of MBFSL.

** By entering the Contest, the participant agrees that MBFSL shall not be liable for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or with the acceptance, possession, or use of any Prize

** Decision of MBFSL in relation to the Contest and matter incidental thereto shall be final and binding on the customer. Dispute if any respect of the Contest should be sent in writing to MBFSL. Any and all disputes, controversies and conflicts (herein after referred to as“Disputes”) arising out of the Contest shall be referred to a sole Arbitrator to be appointed by the Director of MBFSL in accordance with the Arbitration and the Conciliation Act, 1996. The place of arbitration shall be New Delhi and the language used in arbitral proceeding shall be English. The decision of the Arbitrator will final and can not be challenged in any court any where in India. Subject to the dispute resolution procedure as set out here in above, the courts at New Delhi shall have the exclusive jurisdiction in respect of all the subject matter with relation to the Contest.

** As per section 194B of Income Tax Act, 1961, if the prize money is not in cash but in kind or partly in cash or party in kind then the receiver of the prize is required to deposit the tax calculated @ 30% of the aggregate value of the prize, which will be bearded by the winner.

** The London trip journey date can maximum be exceeded to 31st December 2015.
