Mauke Pe Chauka Festive Contest 2015:
The Contest “Mauke Pe Chauka” (hereinafter referred to as ‘Activity’) is open to all Aircel Retailers who are citizens of India and above 18 years of age selling Aircel pre-paid connections and recharge coupons (“Participant”).

This Document Is An Electronic Record In Terms Of The Information Technology Act, 2000 And The Amended Provisions Pertaining To Electronic Records In Various Statutes As Amended By The Information Technology Act, 2000. This Electronic Record Is Generated By A Computer System And Does Not Require Any Physical Or Digital Signatures.

These Terms And Conditions Contained Herein Govern The Terms Of Participation In The Activity. Participants Entering The Said Activity Shall Be Deemed To Have Accepted These Terms And Conditions.

This is a limited period Activity. The Activity would start on 1st September 2015 at 00:00:01 hrs and end on 22nd October 2015 , at 23:59:59 hrs (“tenure of Activity”).

The Activity requires the Participants to sell 4 (four) Recharge Coupon Vouchers (RCV) denomination of Rs. 74/-, Rs. 111/-, Rs. 144/-, Rs. 194/-, Rs. 195/- and Rs. 344/- .

The Activity is free of charge. The Participant will not pay for the applicable charges for services while on roaming.

Gratification:
The participant who Participates in the Activity and sell 4 (four) RCVs denomination of Rs. 74/-, Rs. 111/-, Rs. 144/-, Rs. 194/-, Rs. 195/- and Rs. 344/-during the Activity Period shall be entitled for one contest participation code:Winner of the contest shall be entitled to win any of the below prizes:

A Motorbike worth Rs. 45000/-(approx) exclusive of taxes and insurance or Television worth Rs. 15000/-(approx) or Silver coin 10 gms.

The Winners will be informed through a call/message on the Winner’s Aircel mobile number or any other communicable address available with Aircel.

Aircel, or its affiliates, subsidiaries, directors, and employees shall not be responsible or liable for non-receipt of call/message. If the winner is not contactable on mobile number or other communicable address including email and no revert from the winner is received within seven (7) days after first attempted notification, Aircel shall be entitled to give the prize to the next available winner and the original winner’s entitlement to the prize will lapse without any recourse to Aircel. Aircel offers no guarantee or warranty in relation to opportunity to win this Activity. All decisions of Aircel in relation to Activity shall be final and binding upon participants.

Participant(s) who breach the terms, in any manner, shall be disqualified from the Activity and Aircel may take legal action against them.

Aircel shall reserve the right to use all data, material etc. received from participants as part of this Activity as it may deem fit.

Aircel expressly disclaim all warranties of any kind, whether express or implied. Aircel shall not be responsible for sub-standard quality or any defects of any nature in the Prize/product supplied by manufacturers, including any damages done in transit. Any claim in respect of any product is a subject matter of the product manufacturer and all enquiries for warranty / defect related claims or disputes shall be directly settled between the Winner and the manufacturer of the said Product.

Notwithstanding anything stated herein, Aircel reserves the right to stop the Activity at any time and/or change, modifies, withdraw, or extend the Activity without any prior notice and no correspondence in this regard shall be entertained. Aircel reserves the right to withdraw/change / modify the content and terms and conditions at its own discretion and without any prior notice and / or assigning any reason.

The winners will be mandatorily required to submit his/her full name, contact number, complete residential address, email id, self-attested copy of PAN CARD (Front & Back Page) or other ID proof, age proof or any other document as required by Aircel.

Winner has to submit his/her relevant documents within thirty (30) days of publication/communication of his name as a winner in the Activity, else the gratifications will be declared as null and void, and Aircel reserves its right to give the prize to the next available/selected winner.

The selection of the type of prize will be determined at the sole discretion of Aircel. Prizes cannot be substituted for other articles or gifts or cash by the winner. Any expenditure with regards to delivery and/or enjoyment of prize will be the responsibility of the winner. All applicable government taxes/duties if any on prizes are to be borne by the winners.

No correspondence shall be entertained with regard to the Activity.

The employees of Aircel or any associated companies including distributors, franchisees, vendors and members of their immediate family will not be eligible to participate in the Activity.

Aircel shall not be responsible for any loss or damage that occurs to any Participant or any of their designated nominee(s) due to participation into this Activity.

The Participants expressly agree and acknowledge that all information submitted by him/her, is true, current and complete.

Aircel at its own discretion can accept or reject any entries of Participant or winner selection and no objection in this regard shall be entertained including but not limited to non-compliance/failure of terms hereof, or lack of complete address and other details of Participants as requested, etc and Aircel reserves its right to give the prize to the next available winner.

Activity shall be subject to the laws of India.

All or any dispute arising hereof shall be subject to the Courts having jurisdiction in Chennai.

Aircel or its directors / officers / employees shall in no way be responsible for circumstances beyond its control, which hinder the completion of the Activity. Notwithstanding anything stated herein, Aircel shall not be liable for any failure to perform any or all of its obligations hereunder is due to or attributable to acts, events, omissions or accidents beyond the reasonable control of the Aircel, including act of God, fire, lockout, strike or other official labor dispute, union problem, riot or civil commotion, terrorism, satellite failure, failure of technical facilities not within the reasonable control of Aircel, act of public enemy, enactment, rule or order or act of government, such act or event being deemed an event of Force Majeure.

Participant/Winner(s), if required by Aircel, agrees to participate in image photos, video shoots and/or film shooting sessions so required for any Aircel’s advertisement campaign, promotional or otherwise related purpose. Participant/Winner hereby agree that Aircel shall have the right to use such photos, videos and/or films in any medium of communication (including, without limitation, print, press, internet or any multimedia medium) and in any reasonable manner as Aircel may decide in its sole discretion, without any restriction or limitation whatsoever. Aircel shall ensure that such use of Participant/Winner(s) image photo, video and/or film shall be free from any vulgar, obscene, misleading, defamatory, derogatory or libelous depiction. The names, addresses, telephone numbers, e-mail identities and/or photographs of Participant/Winner(s) may be used by Aircel for sending out commercial information and/or for other commercial, publicity or promotional purposes.

Aircel will in no event be liable for any damages – direct, indirect, special, incidental, or consequential arising out of the Activity or use of the prizes given through the Activity to participant/Winner.

In the event of any discrepancy or inconsistency between these terms and conditions and any brochure, marketing or promotional materials relating to promotion these terms and condition shall prevail.

If any provision (or any part thereof) of this Terms and Condition is held by a court/ tribunal of competent jurisdiction to be illegal, invalid or unenforceable, that provision (in whole or part as the case may be) shall be severed and the remaining provisions shall remain in full force and effect.
