Clear Shampoo “Meet & Challenge Virat” Contest 2015:
1. Acceptance :
1.1. These Rules and Terms of Service comprises the complete Agreement and Contract between you (“user”) and www.clearparis.in (Clear Shampoo) in relation to the service/s provided by Clear Shampoo at its website www.clearparis.in (“The Site”) and/ or over telephone/mobile and supersedes all previous agreements, contracts and communications (oral or written) in this behalf. By calling the IVR questions/selecting responses on the number 09004190041 correctly you bind yourselves to the provisions of these Terms & conditions of service.
2. Definitions :
2.1. Clear Shampoo means the company, corporation, firm, individual or association of persons currently administering, providing content for, maintaining and otherwise managing the Site and every employee of Clear Shampoo (Hindustan Unilever Limited) and its advertising agent or agents for the time being and their employees, and every consultant, advisor and associate of Clear Shampoo and their respective employees.
2.2. “Contract”, “Agreement” and “Terms of Service” refer to the terms and conditions herein set forth.
2.3. “Employee” means every person working in any capacity for Clear Shampoo (Hindustan Unilever Limited) as defined herein and includes every member of his family and every person residing in his household as a member of his family.
2.4. “Hosting”, with all its grammatical variations, means and includes the provision of Services by Clear Shampoo at the site and subject always to the provisions of the Contract.
2.5. “Personal Information” means all information about the user provided to Clear Shampoo by any means of communication, whether electronic, oral or written.
2.6. “Site” with all its grammatical variations refers to the web site hosted on the Internet/World Wide Web with the address of www.clearparis.in such other address as may periodically be assigned to or adopted by Clear Shampoo.
2.7. “Services” means Clear Shampoo offers the user, on an “as-is” and “when available” basis, the opportunity to participate in all promotions, games scheme hosted for the time being on the Site or on the phone by Clear Shampoo or on behalf of Clear Shampoo.
Terms and Conditions for participation in the “Meet & Challenge Virat” (‘the Activity’):
3. Words conveying the singular shall, where required or appropriate be deemed to mean and include the plural. Words conveying the feminine gender shall be deemed to mean and include the masculine gender.
4. The Promotion shall run from 24/04/2015 to 28/06/2015 (‘Activity period’).
5. The Promotion is open for all the residents of India who are 18 years of age or above.
6. To enter the Promotion the Consumer is required to given a missed call on 09004190041, the number specified on the ad after buying a bottle of any variant of Clear shampoo worth Rs 72 or more.
7. Post the missed call Consumer from Non Tamil Nadu State shall receive an Outbound Call (OBD) in which they will need to enter the 13 digit barcode from the back of a Clear Shampoo bottle. After this they will need to select any of the 3 challenges for Virat. For Consumer from Tamil Nadu State, the consumer has to complete recording their message on the IVR.
8. One telephone number shall be entitled to two attempts only or enter 2 barcodes only.
9. By participating in this Promotion, the Consumer fully and unconditionally agrees to and accepts the Terms and Conditions available www.clearparis.in (‘Programme Website’) as well as the decisions of HUL and/or the Technology Partner and/or the On-Ground Activation Partner, which shall be final and binding in all matters related to the Programme.
10. HUL or its technology partner shall not be responsible if for some reason the Consumer is unable to connect to the said number for any reason whatsoever.
11. HUL does not accept any responsibility or liability towards the personal security or property of the Consumers in the course of taking part in the Promotion.
12. HUL reserves the right to alter, modify or change any terms and conditions herein or modify/change, discontinue, terminate, withdraw the Promotion at any time during the Promotion Period at its sole discretion without prior notice or assigning any reason.
13. If, in the sole opinion of HUL, the reasons where for HUL shall not be bound to disclose, the User has contravened, committed hacking or committed breach of any of the terms of this Agreement, HUL shall be entitled, without any notice, to terminate the user’s affiliation with the brand.
14. HUL retains the right to contact the Consumers any time after the end of the Promotion Period.
15. The personal information shared with HUL and its technology partner or On Ground Activation Partner, whether public or private, will not be sold, exchanged, transferred, or given to any other company for any reason whatsoever, without the consent of the Participant.
16. Indemnity by User:
16.1. The User agrees and undertakes to indemnify and hereby indemnifies and keeps safe and harmless Clear Shampoo from all loss, claim, demand, damage, costs, charges (including legal fees and charges) or prejudice that may be caused on account of the User’s use of the Service offered by Clear Shampoo at the site or on phone.
16.2. The User agrees and undertakes to indemnify and hereby indemnifies and keeps safe and harmless Clear Shampoo from all loss, claim, demand, damage, costs, charges (including legal fees and charges) or prejudice that may be caused on account of the User’s default or breach of any of the terms of this Agreement.
16.3. The Company urges responsible participation from all users. Hence the service must not be used with a malicious intent.
17. All disputes with respect to this Promotion are subject to the exclusive jurisdiction of the Courts or forums in Mumbai only.
18. The winners will be selected by a lucky draw in rest of India and 1 winner will be selected from Tamil Nadu separately based on the quality of answer recorded which will be judged by a jury appointed to represent HUL. In total 5 winners will be selected who will be given a chance to meet and challenge Virat to one of the 3 options enlisted in the IVRS . The activity will be live till 28th June and the winners shall be announced on 10th July.
