Zoom TV #Buddiez Contest 2015 Season 2:

Zoom is reaching out to all the youth in India to find the coolest #Buddiez. They have to submit their entire details and register with us. Post shortlisting and voting, the winner will be announced. They will win an all-expense paid trip to Goa and will also feature in an exclusive music video that will capture their carefree spirit and a lifetime of friendship, for everyone to see!

These terms and conditions (“Terms”) are applicable and govern the contest for “#Buddiez”, organized by the Television Division of Bennett, Coleman & Company Limited (“BCCL”) for its Bollywood based entertainment channel “Zoom” (“Channel”) on its microsite (“Website”) (“Contest”). The Website may also be linked to Facebook and Twitter pages of the Channel.

This Contest is a contest to identify certain talent as provided below. For the purpose of this Contest, any group who participates by way of registering themselves on the Website will be treated as a participant (“Participant”). By participating in the Contest, Participant agrees to abide by and be bound by these Terms. BCCL reserves the right to modify these Terms without any prior notification. Participant is advised to regularly review these Terms. If Participant does not agree with any of the Terms and any amendments thereto, he/she must not use this site/service and/or participate in the Contest.

The Website shall be available for participation for 40 days on the Website from October 30, 2015 (“Participation Period”).

Terms & Conditions:

1. Participant should be a citizen of India and between 18 years to 25 years of age. Employees, directors, and/or officers (including immediate family members or members of the household) of BCCL, its subsidiaries, affiliated companies, distributors, advertising, fulfilment and promotion agencies and all other companies or entities associated with the Contest are not eligible to participate.

2. This Contest is a hunt for the coolest set of buddies in India. BCCL will visit almost 35 colleges out of which 10 colleges will be from Delhi and Mumbai each and 5 colleges each from Pune, Kolkata and Bengaluru for activation. Each group that wishes to participate shall have at least 4 members or maximum 5 members. The group shall not have more than 1 girl. The group shall be required to register themselves on the Website during the Participation Period.

3. During the Contest and after the Participation Period, BCCL will reveal the top 10 cool gangs on the basis of the testing criteria developed by BCCL. Such top 10 cool gangs will be required to upload their profile video on the Website and get as many votes as possible. Any votes given post the Last Date will not be counted. Please refer to the frequently asked questions (“FAQs”) on the Website to understand the process of the Contest better.

4. Anytime post the final Last Date, BCCL will announce the winner of the Contest which would be based on the combination of number of votes garnered by the Participants and also subject to the decision of the panel of judges at BCCL who would judge the Participants on the basis of their cool quotient and certain criteria set by BCCL (“Winner”). Winner will be announced by BCCL on the Website. BCCL reserves the right to delay the announcement of the Winner.

5. Each Winner will be eligible for an all-expense paid vacation in Goa along with a chance to be featured in a music video (“Prize”). BCCL will be responsible for their travel, stay and food expenses. BCCL reserves the right to select the Prize given to each Winner and also to change the Prize, at its own discretion. The Winners shall make themselves available at the time and place as determined by BCCL for the shoot of music video and on the date as determined by BCCL for the trip to Goa.

6. On the announcement, the Winners will be required to provide his/her complete name, valid mobile number and residential address at the designated e-mail id provided by BCCL. Notwithstanding anything contained herein or Participant’s participation in the Contest, only the person whose information is provided to the designated e-mail id shall be given the Prize and BCCL shall not be liable to any other person for the same.

7. BCCL’s decision on selection of the Winners of the Contest shall be final and binding. BCCL shall not entertain any questions, enquiries on the manner/method of selection of the Winners’ declaration and relating to the Contest from any party whatsoever.

8. Participants agree and grant the right to BCCL to take or use their photos and videos in any manner as determined by BCCL. The entire intellectual property rights in the Contest and the show shall at all times vest with BCCL and the Participants hereby waive all the rights to claim any ownership in whole or in part of the show or Contest.

9. Responses received for the Contest after the expiry of Participation Period will not be considered.
10. BCCL will contact the Winners directly at the mobile number, email address or through social media provided.

11. Participant agrees that he/she shall enter this Contest at their own will and BCCL is not in any way obligated or liable for any loss or costs that Participant may suffer or incur and nothing is payable to the Participant for participating in the Contest.
12. Participant shall in no event use any derogatory or foul language or obscene pictures while uploading their names on the Website and the same shall result in disqualification.

13. The Winners must claim their respective Prize within 15 days of the announcement of Winner by BCCL on the Channel. In the event, Winners don’t make themselves available on the time and date as required by BCCL, the Winners will be disqualified and BCCL reserves the right to choose from the set of other Participants a new winner.

14. The Prize is not transferable and shall not be assigned to any other person, party or organization. There is no cash substitution, cash redemption or cash value in lieu of the Prize.
15. BCCL does not warrant the quality of Prizes. All taxes, levies and charges relating to the Prizes will be borne by the Winners.

16. In the event that the Prize is unclaimed by the Winner or the Prize is returned as ‘undelivered’ due to any reason or BCCL is unable to contact the Winner on his mobile number the same will result in forfeiture of the Prize by the Winner and BCCL shall not entertain any claims in this regard thereafter.

17. BCCL may discontinue this Contest anytime without any prior written notice.
18. BCCL reserves the absolute right to disqualify any Participant, if it is of the opinion that he/she has used improper technical means to participate in the Contest, any information provided by any Participant is found to be incorrect, inaccurate, false, misleading in any manner or due to any other valid reason that may nullify his/her Participation in the Contest.
19. BCCL’s decision on any dispute in relation to the Contest shall be final and binding on the Participant.

20. BCCL, its directors, employees, affiliates, agents and representatives shall in no manner whatsoever shall be responsible and/or shall not be held liable for any damage or loss (including but not limited to indirect or consequential loss) arising from personal injury, death, mental trauma or loss of, or damage to property, caused to the Participant (including Winners) or any party sustained in connection with the Contest or the Prizes related to the Contest.

21. BCCL, its directors, employees, affiliates, agents and representatives shall not be responsible or liable for any failure or malfunction of any computer servers or equipment, hardware or software or for lost, incomplete, delayed or garbled data transmission or any combination thereof; (v) for any injury, loss or damage caused to Participant or any third party due to Participant’s participation in this Contest.

Note:

1. By participating in the Contest Participant permits BCCL to use the answers posted by him/her and his/her Information on any media/social media platform, any other multimedia activation/event and/or which shall include trade publications, press releases, electronic, Channel website, the BCCL web site, the Channel, any other media property or any display format selected, owned or controlled by BCCL.

2. Participant hereby indemnifies BCCL, its employees, officers, directors, contractors, contest partners, contest sponsors in relation to this Contest and hold them harmless against any loss, claim, demands, costs, damages, judgments, expenses or liability (including reasonable legal costs) arising out of or in connection with any or all claims, that may be brought against BCCL by any third party in connection with Participant’s participation in or winning the Contest, which is inconsistent with any of the representations made by Participant and/or information provided by Participant hereunder, due to breach of any third party rights including intellectual property rights, due to any wilful misconduct, fraud or malfeasance and shall reimburse BCCL for any such loss, costs, expense, or damage to which said indemnity applies. BCCL shall give the Indemnifying Parties prompt written notice of any claim or actions covered by this indemnity, and Indemnifying Parties shall have the right, at its own expense, to participate in any such action.

3. The courts at Mumbai shall have the sole and exclusive jurisdiction in all disputes arising out of this Contest or relating to the use of the BCCL services for this Contest
