Xiaomi India Private Limited (“Xiaomi”) brings this unique opportunity to its users and fans (hereinafter referred to as “Users” or “You/ Your or Mi Fan/Redmi Note 3 Challenger”) to experience the Redmi Note 3 before its launch in India.

This Xiaomi Redmi Note 3 “Mi Generation” Prelaunch Challenge (hereinafter referred to as “Redmi Note 3 Challenge”), is presented to You on this website mi.com (the “Website”) and mobile application (“Mi Media”) starting from 00:00 IST on 14 January 2016 and shall continue untill the closure as announced by Xiaomi (the “Usage Period”).

As part of this Redmi Note 3 Challenge, selected Mi Fans will experience a Redmi Note 3 mobile device free of cost subject to the terms and conditions mentioned below. The Redmi Note 3 mobile devices shall remain the property of Xiaomi at all times throughout the Usage Period and You shall be permitted to use and experience the same as part of the Redmi Note 3 Challenge.

Terms & Conditions :

1. This Redmi Note 3 Challenge is valid only for the territory of India and only for participants aged 18 years and above. By participating in the Redmi Note 3 Challenge, You represent and warrant that you are competent to enter into binding contracts under applicable laws.
2. All interested Mi Fans are required to fill out the application form hosted on the Website by 31 January 2016.
3. Xiaomi shall select the participants (the “Experiencers”) for the Redmi Note 3 Challenge from the interested Mi Fans and shall announce the selection by 31 January 2016.
4. Experiencers shall be required to create original work of photography, video, audio, written content and any other content created by the Experiencer, using Redmi Note 3 mobile device (hereinafter referred to as “Content”).
5. Once Content is uploaded in Mi Media and on social media by the Experiencer, You give your consent to agree to the terms and conditions, promotional guidelines of Facebook, Twitter and other third party social media websites where your Content will be uploaded.
6. If the Redmi Note 3 provided to You is either damaged, lost, sold, or are otherwise deemed unusable, Xiaomi reserves the right to disqualify you from the Challenge, confiscate the device, and/or seek damages.
7. The Experiencer agrees not to use the Redmi Note 3 mobile device for any unlawful activity. The Experiencer agrees to immediately inform Xiaomi on occurrence of any damage or theft or loss of Redmi Note 3 mobile device. If the Redmi Note 3 mobile device is lost or stolen then You shall file an FIR within 24 hrs.
8. The Experiencer agrees that he/she shall take same amount of care as a prudent person would take of his/her own property. At the time of closure of the Redmi Note 3 Challenge, the Experiencer shall return the Redmi Note 3 mobile device to Xiaomi, in the same condition as the Redmi Note 3 mobile devices were received by the Experiencer.
9. All Content provided by You should be original work, which shall include only content created originally by You and not based on or rely on any third party content or any third party intellectual property. If the Content features any persons, please ensure that you have obtained the necessary consents, no-objections and permissions from such persons.
10. If Content is designed or developed by several people, all contributors should agree to participate in the Redmi Note 3 Challenge. The prize will be given to that Experiencer who is the owner of the Mi account from which the Content was uploaded.
11. The Content must be presented in accordance with the applicable laws of India.

12. You shall guarantee that the Content will not contain:
a. content that threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation;
b. maps of disputed areas, flags or national emblems;
c. religious symbols or other blasphemous content, defamatory, disparaging or libelous content;
d. obscene, pornographic or pedophilic content;
e. content that harms minors in any way;
f. hateful, grossly harmful or harassing content;
g. scenes of excessive violence;
h. racially or ethnically objectionable content;
i. politically incorrect and controversial content;
j. content that is related to or encouraging money laundering or gambling;
k. content that infringes any patent, trademark, copyright or other proprietary rights;
l. content that is invasive of another’s privacy;
m. content(s) arising out of, or associated with a person’s name, voice, signature, photograph, or likeness, including without limitation rights of personality, privacy, and publicity without their consent; and
n. content that violates any law for the time being in force in India or is otherwise unlawful in any manner.

13. You shall not perform any system abuse of the Redmi Note 3 or any other Xiaomi device. You shall also not distribute or transmit any software virus, destructive code, whether or not damage is actually caused thereby.
